Open the deadline for interested parties to report on the offending markets to incorporate into the future European Watch-List of Counterfeiting and Piracy
Starting from a similar initiative in the US where a list has been created with sites with infringing content, the European Commission has just launched a consultation that will serve to draw up its own list, called Counterfeit and piracy watch list.
The creation of this Watch List falls within the strategies and initiatives that are being implemented from the Commission due to the challenges that have arisen regarding the protection of industrial and intellectual property (IP) rights in the EU.
In this regard, it is necessary to take into account the study recent report prepared by the European Union Intellectual Property Office (EUIPO) and the OECD, which indicates that up to 5% of all annual imports to the EU are counterfeit or pirated products.
These fraudulent practices cause serious losses to rights holders and, in addition, the investment, innovation and employment of European companies are seriously threatened.
La European Commission has launched a new project aimed at flagging and identifying physical and, especially, online markets outside the EU linked to counterfeiting and piracy.
The announced list will be a large database of the sites more problematic, supported by the information provided by interested persons. The Commission will carry out a thorough verification of this information to confirm the actual infringement of protected IP rights. Informants may keep their identity confidential if they wish.
La watch-list It will have a triple function:
- It will make consumers aware of the safety, health and environmental risks caused by the acquisition of fraudulent goods and services.
- Authorities and rights holders may take appropriate measures to reduce the availability of said infringing goods or services.
- The owners and operators of these markets will be encouraged to adopt business models based on the authorized distribution of legitimate content and products.
The European Commission has opened a Plazo that ends next March 31th 2018 for any interested party to contribute to the identification of online or physical sites that infringe IP rights.
We are faced with a great opportunity to publicly highlight the increasingly numerous infractions committed, especially over the Internet.
