Increase in the number of counterfeit goods detained by EU customs in 2015

La
The European Commission has just published, on September 23, its report on the results of border measures against the usurpation of industrial and intellectual property rights carried out in 2015.

De
According to this report, in 2015 they were detained at EU customs
a total of 40.728.675 products suspected of violating these rights,
representing an increase of 14% compared to the 35.568.982 products retained
in 2014. The value of products retained in the EU 2015 exceeded 642
millions of euros.
En
In the case of Spain, the increase in products retained in 2015 was greater:
increased by 17% compared to 2014 (1.893.019 products retained in 2015
compared to 1.619.264 products retained in 2014). Spain is still in
of the top 10 from EU countries with
greatest number of retained merchandise, specifically in position No. 9.
La
effectiveness of the border measures provided for in Regulation (EU) 608/2013
is very high: the detained goods were destroyed in 80% of the cases
of retention, judicial proceedings were initiated in 9% of the cases and
They only turned out to be original products in 2,7% of the cases.
China
continues to be the main country of origin of the products retained by
EU customs (40%). By category, merchandise also has its
origin in the following countries: Benin (food), Mexico (drinks
alcoholic), Morocco (other beverages), Malaysia (care products
body), Turkey (clothes), Hong-Kong (mobile phones and accessories,
memory cards, computer equipment, CD/DVD and lighters),
Montenegro (cigarettes) and India (medicines).
The
daily use products that could be dangerous to the health and safety of
consumers (such as food, beverages, toiletries, medicines,
appliances, toys, etc.) represent 25,8% of the total
withholdings.
The
most used means of transport, due to the number of retentions produced, continue
being shipments by postal mail and courier services (77% of
withholdings), corresponding to purchases made over the Internet.
The
The main merchandise retained in 2015 was cigarettes (27%); others
products, including batteries, glue, furniture and lamps, manuals and others
documents, magnets, pesticides, etc. (10%); toys (9%); permanent labels,
temporary labels and stickers (8%); and
food (7%).
Calls
powerfully the attention that the aforementioned labels and stickers have received
be inside the top 5 families
retained in 2015, which confirms the last technique used by the
criminal counterfeiting organizations consisting of importing products without
mark and, separately, import the labels and stickers with the marks, proceeding
to place the brands on the products already in EU territory. This
technique was already highlighted by Europol and the EUIPO in their report 2015 Situation Report on Counterfeiting in the European Unionn April 2015.
