For over a century, this WIPO-administered system has enabled creators and companies to protect the appearance of their products in multiple markets through a single procedure, promoting a global ecosystem of innovation, beauty, and utility. A century protecting creativity: anniversary context The Hague System was created in 1925 with the aim of providing a simplified way to protect designs beyond borders. The first applications, such as fabrics for ladies' hats, contrast radically with the current records of graphic interfaces, robots, or electric vehicles. During this time, the system has grown from 11 initial signatories to 82 member states and intergovernmental organizations from 99 countries. Today, the numbers speak for themselves: More than 2 million industrial design registrations since the system's creation. A regulatory change that modernizes the filing of inventions Starting October 1, 2025, the European Patent Office (EPO) will allow the inclusion of color and grayscale figures in electronic patent applications. This regulatory change represents a significant advance in the digitalization of patent procedures, facilitating a more accurate and visually clear representation of inventions. Until now, regulations required that all figures be presented in black and white, even in cases where color was essential to illustrate technical aspects. With the new measure, combinations of color, grayscale, and black and white figures will also be accepted, providing greater flexibility for applicants. Why is this change relevant? Figures are an essential element in the description and understanding of an invention, especially in those fields of technology where the visual representation and, more specifically, the chromatic component, is decisive for understanding the proposed technical solution. This change thus introduces greater flexibility for applicants who, until now, could only file patents with black and white figures. However, this new possibility comes with certain limitations and recommendations that should be taken into account. What happens with international applications (PCT)? It should be noted that this new possibility does not extend to international applications filed under the Patent Cooperation Treaty (PCT). Although it is possible to include color or grayscale figures in the PCT application, they will be converted to black and white upon international publication, as established by the PCT system. However, when the international application is filed electronically, the International Bureau retains the original color or grayscale version. This version will be available to both the public and national or regional offices through the PATENTSCOPE platform, and an indication will be given on the cover of the publication as to whether the version is accessible. For Euro-PCT applications entering the European phase on or after October 1, 2025, the processing of the application will be based on color or grayscale figures, provided they are available in PATENTSCOPE and the international publication expressly reflects this. Technical and legal recommendations for applicants and professionals This regulatory change introduces new considerations that applicants and professionals in the sector must take into account. Patent attorneys should be familiar with the technical details of filing color or grayscale figures, especially when filing these figures in the electronic formats required by the EPO. The technical quality of the figures will also be another determining factor, since an incorrect or deficient presentation can affect both the technical understanding of the invention and its legal protection. Furthermore, it is recommended not to make reference in the text (description, claims or summary) to specific characteristics of the colour of the figures, such as “yellow” or “cream”. This is because color specifications cannot always be objectively and uniquely identified, which could lead to legal ambiguities. Modified figures and omitted elements: what limits exist? The possibility of submitting figures in color also extends to electronic modifications made on or after October 1, 2025. However, these must comply with the conditions provided for in Article 123(2) of the European Patent Convention (EPC), relating to added subject matter. In the case of figures modified in response to an objection, they may only contain color or grayscale content to the same extent as the original figures submitted. Likewise, if the elements are omitted or figures are corrected, applicants must ensure that they correspond exactly to the content and format of the figures in the priority application. If the original figures were presented in black and white, any corrected or omitted figures must respect that format. What implications will this have for European patent validations in Spain? Once the European Patent Office has granted and published a European patent with color or grayscale drawings, the Spanish Patent and Trademark Office will require the applicant for validation of that European patent in Spain to ensure that the Spanish translation includes the color or grayscale drawings.   The EPO's decision to allow color and grayscale figures in electronic applications marks a milestone in the evolution of the European patent system.
