"Toward a Digital Jurisdiction": Elzaburu at the 36th Marques Conference

“Toward a Digital Jurisdiction,” a panel discussion at the MARQUES Annual Conference. Brands and institutions must adapt to meet consumers’ new expectations. Our Associate Partner Miguel Ángel Medina, a member of the MARQUES Council, chaired a session that examined the shift toward a digital jurisdiction.

During this panel discussion, our partner Javier Fernández-Lasquetty spoke about how the increasing digitization of the economy has created a disconnect between the “digital” challenges faced by #IP rights holders and the response from the courts. He described developments in this area and how, in practice, digital platforms have offered a quick and inexpensive—but imperfect—solution.

He therefore proposed the creation of a supranational system that rights holders could turn to for dispute resolution, with decisions that would be enforceable throughout the “digital territory.” Also participating in the interesting debate were Leandro Toscano, Head of the Business Development Unit at the WIPO Arbitration and Mediation Center in Switzerland, and Ricardo Pérez of Kantar.
